1 Introduction
PropHive is owned and operated by PropHive (Pty) Ltd, registration number: [Insert Registration Number]. PropHive operates as a fully online platform with no physical office or postal address.
PropHive hosts a website under domain name www.prophive.co.za ("the Website") for the online marketing of property listings for sale or for rent, roommate matching, commercial and residential rental management, and related services designed to connect property owners, tenants, and seekers (collectively "Advertisements").
PropHive may amend these terms and conditions ("T&Cs") at any time. We will notify users of significant changes via email or pop-up notifications on the Website. Continued use constitutes acceptance. For major changes, re-acceptance may be required.
2 Definitions
The terms "you" and "user" refer to all individuals and/or entities accessing the Website. "Client" refers to those who advertise on the Website under a signed agreement. "Website" refers to www.prophive.co.za, PropHive apps, and related services.
3 Acceptance of Terms
By accessing or using the Website, you agree to be bound by these T&Cs. If you do not agree, discontinue use immediately. You must be at least 18 years old to register and use PropHive.
4 Application to Clients and Users
These T&Cs apply alongside any signed contract with Clients. In case of conflict, the contract prevails. Users agree to these T&Cs by accessing the Website.
5 PropHive's General Obligations and Warranties
PropHive will display and market Advertisements provided by Clients, subject to reasonable limitations on number, type, content, and design. We provide telephonic support from Monday to Friday, 08:00 to 17:00.
The Website is provided "as-is" without warranties. PropHive does not guarantee error-free operation, 24/7 availability, or virus-free downloads. We disclaim involvement in property transactions and are not an estate agent, attorney, or financial advisor.
6 User and Client Obligations and Warranties
You must provide accurate, current, and complete information for accounts and Advertisements. Maintain confidentiality of login credentials and report unauthorized use immediately. One account per user; no sharing. Accounts inactive for 24 months may be deleted.
Content must not be false, misleading, defamatory, obscene, discriminatory, or illegal. Comply with all laws, including the Consumer Protection Act (CPA) and Protection of Personal Information Act (POPIA). Report violations to support@prophive.co.za.
You warrant that content does not infringe IP or privacy rights. You indemnify PropHive against claims arising from breaches.
PropHive believes all consumers should be treated equally regardless of gender, race, creed, socio-economic standing, or nationality. We do not tolerate discrimination.
7 Services Offered
PropHive offers property listings, roommate matching, rental management, tenant screening, property offers, searches, calculators, alerts, and newsletters. Services may depend on third-party integrations; PropHive disclaims responsibility for their accuracy or reliability. No guarantee of transaction success.
8 Use of the Website
PropHive does not verify ad accuracy; use at your own risk. We use cookies for personalization (see Cookie Policy). No linking without consent. Third-party links are not endorsed.
Prohibited: Transmitting harmful material, using bots/spiders, overloading infrastructure, reverse engineering, unauthorized access.
9 Security
Prohibited: Unauthorized access, probing vulnerabilities, interfering with services (e.g., viruses, spamming), forging headers. Violations may lead to civil/criminal liability; PropHive will cooperate with law enforcement.
10 Payment and Subscription Terms
Free and premium services available. Fees specified on the Website; payments non-refundable unless stated. Include processing fees. Billing disputes resolved via support@prophive.co.za. Cancel subscriptions with 30 days' notice; failure to pay may suspend/terminate account.
11 Intellectual Property Rights
All content, trademarks, logos, designs, software are owned by PropHive or licensors. No license granted except for viewing. Users grant PropHive a perpetual, royalty-free license to use submitted content (e.g., photos, descriptions) for platform purposes.
For Visual Content (photos/videos) produced by PropHive: We own IP; limited license for Client use on approved platforms. Breaches allow termination.
12 Privacy Policy and Personal Information
We collect personal info (name, ID, contacts, searches) for services, marketing, and analysis. Consent to use/disclosure for communications, improvements, validations, and legal requirements. Opt-out from marketing via settings.

For Tenant Screening/Property Offers: We share data with partners per data protection laws.
13 Disclaimer and Limitation of Liability
PropHive not liable for indirect, incidental, special, or consequential damages. Disclaims accuracy of third-party content/links. Not responsible for agreements/decisions from Website use.
Force Majeure: No liability for events beyond control (e.g., natural disasters, cyberattacks).
14 Indemnities and Waivers
You indemnify PropHive against claims from your actions, content, or breaches. Waive claims for losses from Website use/inability.
15 Termination
PropHive may suspend/terminate for violations, with 7 days' notice (except urgent cases). Appeal via support. Post-termination: Data deleted per POPIA within 30 days.
16 Confidentiality
Keep business info confidential, except public or consented data.
17 Direct Marketing, Cooling-Off, and Refunds
For Direct Marketing Contracts: Cancel within 5 business days for full refund. No other refunds unless specified.
18 Governing Law
Governed by South African laws. Disputes resolved in South African courts.
19 Dispute Resolution
Disputes first to Managing Directors, then arbitration in Cape Town per Arbitration Foundation rules. No appeal; interim relief via courts allowed.
20 Severability
Invalid provisions severable; remainder enforceable.
21 Sub-Contracting
PropHive may sub-contract without consent; you may not without ours.
22 Email Disclaimer
Emails may contain confidential info; destroy if not intended recipient. Opinions not facts; no liability for reliance. Emails deemed sent/received per server logs. Virus-free efforts but no guarantee. Emails monitored for quality/security.
23 Responsible Advertising Code
PropHive adheres to ethical advertising; investigates/removes hateful, incorrect, or discriminatory content.
24 Changes to Terms
PropHive may update T&Cs; notifications provided. Continued use accepts changes.
