1. Scope
These Terms & Conditions apply on top of our Terms of service when you advertise a property, act as an agent or landlord, or send an enquiry through PropHive.
2. Advertisers: listing standards
- You must be the owner, a person authorised by the owner, or a registered property practitioner.
- Listings must be accurate and current: price, location, availability, photos and what is included in the rent. Photos must show the actual property.
- Remove or pause a listing once it is let.
- One listing per property. Duplicates and “bait” listings will be removed.
- Do not post contact details in photos or the title where the platform provides a contact form.
3. Agents and agencies
If you are a property practitioner you must hold a valid Fidelity Fund Certificate issued by the Property Practitioners Regulatory Authority (PPRA) and comply with the Property Practitioners Act 22 of 2019. We may ask for proof and may remove your listings and badge if it lapses.
4. Landlords: your legal duties
- Provide a written lease on request and give the tenant a copy.
- Hold deposits in an interest-bearing account and handle refunds as required by the Rental Housing Act 50 of 1999.
- Do not unfairly discriminate against prospective tenants. Follow the rules on inspections and lease termination.
- Do not charge a viewing or “holding” fee that is not permitted by law or that you do not disclose upfront.
Disputes between landlords and tenants can be referred to the provincial Rental Housing Tribunal.
5. Renters and enquirers
- Use enquiry forms honestly and do not send bulk or abusive messages.
- Never pay a deposit, rent or fee before viewing the property and signing a lease. See our safety tips.
- Your enquiry details (name, email, phone and message) are shared with the advertiser so they can reply.
6. Fees and paid features
Listing a property is currently free. If we introduce paid features (for example featured placement or agency plans), we will show the price in rand including VAT before you buy. For paid services concluded online you may cancel within 7 days where section 44 of the Electronic Communications and Transactions Act applies, subject to the services already supplied.
7. Moderation and removal
We review listings and reports. We may edit formatting, decline, remove or pause any listing that breaks these terms, is reported as a scam, or that we reasonably believe is misleading or unlawful, with or without notice.
8. Indemnity
You are responsible for your listing and your dealings with other users. You agree to compensate PropHive for claims arising from content you post that is unlawful or infringes someone else’s rights, to the extent permitted by law.
9. Complaints
Email [complaints@yourdomain.co.za] with the listing reference and what happened. We aim to respond within 5 business days. Unresolved consumer complaints can be referred to the National Consumer Commission.
