Please read these terms carefully. They explain how you may use PropHive and what you can expect from us.

1. Who we are

PropHive is an online platform that lets advertisers list rooms, apartments and houses to rent in South Africa and lets renters search and contact them.

2. Accepting these terms

By using prophive.co.za (the “Site”) you agree to these Terms of Service, our Terms & Conditions for advertisers and enquirers, our Privacy Policy and our Cookie Policy. If you do not agree, please do not use the Site.

You must be 18 or older, or have the consent of a parent or guardian, to hold an account.

3. What PropHive does and does not do

PropHive is an advertising and communication platform. We are not a party to any lease or agreement between an advertiser and a renter, we do not own or manage the properties listed, and we do not act as an estate agent or property practitioner.

Advertisers are responsible for the accuracy of their listings. We apply checks and a reporting tool, but we cannot inspect every property or verify every claim. Always view a property and read the lease before you pay anything.

4. Your account

  • Give us accurate information and keep it up to date.
  • Keep your password confidential. You are responsible for activity on your account.
  • Tell us promptly if you suspect unauthorised access.
  • One person, one account. Do not impersonate anyone.

5. Acceptable use

You agree not to:

  • post false, misleading, discriminatory or unlawful content, or list a property you are not entitled to let;
  • ask for payment, deposits or fees from a renter before a viewing and a signed lease;
  • scrape, copy or resell listings or data without our written permission;
  • use the Site to send spam or unsolicited marketing;
  • interfere with the Site’s security or operation, or attempt to gain unauthorised access.

6. Content you post

You keep ownership of the text and photos you upload. You give PropHive a non-exclusive, royalty-free licence to host, display, adapt for formatting and promote that content on the Site and in our marketing channels for as long as the listing is live and a reasonable period afterwards.

You confirm that you own the content or have permission to use it, and that it does not infringe anyone’s rights or show identifiable people without their consent.

7. Our intellectual property

The PropHive name, logo, design and software belong to us or our licensors. You may not use them without permission.

8. Third-party links and advertising

The Site may display advertising (including Google ads) and link to third-party websites. We do not control or endorse them and are not responsible for their content or practices.

9. Disclaimers and liability

The Site is provided “as is” to the extent permitted by law. We do not guarantee that it will be uninterrupted or error-free, or that any listing is accurate, available or suitable.

To the fullest extent permitted by law, including the Consumer Protection Act 68 of 2008, PropHive is not liable for indirect or consequential loss, or for loss arising from dealings between users. Nothing in these terms limits liability that cannot be limited by law, or your rights under the Consumer Protection Act.

10. Suspension and termination

We may remove content, suspend or close an account if these terms are breached, if we reasonably suspect fraud, or if the law requires it. You may close your account at any time from your account settings or by contacting us.

11. Changes to these terms

We may update these terms. If a change is material we will notify you by email or on the Site before it takes effect. Continuing to use the Site after that means you accept the updated terms.

12. Governing law and disputes

These terms are governed by the laws of the Republic of South Africa. Please contact us first so we can try to resolve a complaint. You may also approach the National Consumer Commission, the Information Regulator (for privacy matters) or a competent South African court.
